Terms of use

• What this is. A service that analyzes your own sleep data and, separately, supplement protocols sold separately.
• What it is not. It is not a medical service. It does not diagnose, treat, cure or prevent any disease. See the full disclaimer.
• The analysis may not conclude. Sometimes your data is not enough to reach a verdict, and the result will be to tell you so. That is also the service.
• Supplements. Talk to your doctor before taking any supplement, especially if you take medication, are pregnant or have a medical condition.
• Account. You are responsible for your login email. You can delete your account and your data whenever you want.
• Changes. If these terms change, the date above changes with them.

ORIGEN terms of sale

These terms govern every ORIGEN purchase. You accept them when you pay, on the payment page.

Who sells to you

What you buy

• The ORIGEN Protocol. A dietary-supplement plan calculated from your data and your answers, split into 28-day windows. The plan — which bottles arrive and in which window — is frozen at the moment you pay and is exactly the one you see before paying.
• The Detox. Not available: it is not sold or shipped today.
• ORIGEN Premium. A digital subscription to the paid features of the ORIGEN app, monthly or annual, that renews automatically until you cancel it. Your first subscription on the web may start with a free trial. It includes no supplements and no shipments. See Premium and the free trial.
• What you do not buy. You are not buying a medical service, a diagnosis or a treatment. The products are dietary supplements, not drugs. Each bottle's label governs: ingredients, servings and warnings.

Who can buy

• People aged 18 or older. You confirm it with a box when you enter the supplements door and again before paying; without that confirmation the payment does not open, and the purchase is recorded with it. [REVISIÓN LEGAL: minimum age by state]
• With a shipping address inside the shipping area and a valid US phone number.
• Who have completed their safety profile. If your answers advise against a product, the plan does not include it; if none remains, there is nothing to buy.

• We may decline a purchase, or hold a box, if the safety profile, the inventory or the address does not allow it. Anything charged and not shipped is refunded. [REVISIÓN LEGAL — founder decision pending: automatic refund or manual review of the held box]

Protocol price and billing

Before paying you will see, next to the pay button: how many charges there are (N, between 1 and 6), the amount of each, that they are charged every 28 days, the date the subscription ends on its own and how to cancel it.

• When you are charged. The first charge when you pay. The next ones every 28 days from the first, until N are complete.
• It ends on its own. After charge number N nothing else is charged. You do not have to remember to cancel.
• How much. The plan total is split into N equal charges, rounded up to the cent; because of rounding, the sum may exceed the total by less than N cents. The amount of each charge does not change during the Protocol. [REVISIÓN LEGAL]
• Currency and taxes. Prices are in US dollars. If your state's law requires sales tax, it is shown and charged at checkout before you pay. [REVISIÓN LEGAL: state sales-tax registrations and tax calculation, pending]
• Who charges. Payments are processed by Stripe. We never see or store your card. The charge appears on your statement as ORIGEN. [REVISIÓN LEGAL — pending founder confirmation: the «ORIGEN» descriptor on the Stripe products and account (the TEST script sets it on the products)]
• Your consent. Before paying you tick a box of its own, separate from the one for these terms (which you tick on Stripe's payment page), that states the number of charges, their amount, how often they are charged, when they end and how to cancel. We keep proof of that acceptance — the exact text, its version, the date and time and the IP — for at least 3 years. After paying we send you an email with those same terms and how to cancel. • Price changes. The amount of a Protocol already paid for does not change until its last charge. A new Protocol uses the price in force on the day you pay for it, and you will always see it before paying.

Windows and boxes

• One box per charged window. Each window's box is prepared after that window's charge is confirmed. Windows are not all shipped in advance.
• Not every window has a box. If a bottle lasts more than 28 days, it also covers the next window. Before paying you will see which bottles arrive in each window. Each charge is an equal share of the plan total, whether or not that window has a box. [REVISIÓN LEGAL]
• You receive the plan you paid for. We do not change compounds or doses mid-Protocol, even if your data changes. If you think you need a different plan, write to us.
• No substitutes. If a product becomes unavailable or changes, we do not send another in its place: the box is held and we let you know. [REVISIÓN LEGAL — depends on pending code: the customer notice for a held box does not exist yet]

Cancelling

• Any time, at no cost. From your account, which opens Stripe's customer portal, or by writing to emilianodelpalac@gmail.com.
• When it takes effect. At the end of the current 28-day window. From then on no further window is charged.

• What has already shipped is not refunded because you cancel. See the refund and return policy.

ORIGEN Premium: automatic renewal

Premium is different from the Protocol: it does not end on its own. Before paying you will see, next to the pay button, the amount, how often it is charged (every month or every year), that it renews automatically until you cancel and how to cancel — and, if you start with a free trial, how many days it lasts and the date of the first charge — and you will tick a box of its own to accept it, separate from the one for these terms.

• When you are charged. The first charge when you pay or, if you start with a free trial, on the day the trial ends. Then every month or every year from that date, until you cancel.
• Cancelling. Any time, at no cost: online from your account, which opens Stripe's customer portal, or by writing to emilianodelpalac@gmail.com. Cancellation takes effect at the end of the period already paid: until then you keep Premium, and nothing else is charged after that.
• The current period. Cancelling does not refund the unused part of the month or year already paid. [REVISIÓN LEGAL — founder decision pending: refund of the current period, especially for the annual plan]
• Price changes. If the Premium price changed, we would let you know before the next charge, with time to cancel. [REVISIÓN LEGAL: notice period required by state automatic-renewal laws; depends on a pending process]
• Where to buy it. On the web, at blackswanp.com: it is charged through Stripe and governed by these terms. If you buy Premium inside the ORIGEN iPhone app, the purchase is made and charged by Apple with your Apple Account: the price is the one the App Store shows (it may differ from the web price), and any free trial or introductory offer, the renewal, cancellation and refunds follow Apple's terms. That subscription is cancelled on the iPhone, in Settings → your name → Subscriptions, not from your ORIGEN account, and refunds are requested from Apple. ORIGEN Premium: free trial

We sometimes offer a free trial of Premium on the web. If you get one, you will see it before paying, next to the pay button and in the box you tick: how many days it lasts, the price afterwards, the date of the first charge and how to cancel. If you do not see it there, your purchase does not include a trial.

• Who can get it. One per person, only on your first Premium subscription on the web. You cannot get it if you already had Premium on the web — on a trial or paid — with the same account or the same email, even if you later cancelled it or deleted your account. For Gmail addresses, variants with dots or with a «+alias» count as the same email. Calculating the price or opening the payment page without finishing does not use it up. To check this we keep a fingerprint of your email: see privacy. • A payment method is required. To start it you give a card or another payment method on Stripe's payment page, even though nothing is charged today. If no payment method remains on file when the trial ends, the subscription is cancelled without charge.
• How long it lasts. The number of days shown before paying, never more than 14, counted from when you start it on the payment page. During the trial you have full Premium.
• After the trial. If you do not cancel before it ends, the trial turns by itself into a paid subscription that renews automatically until you cancel it: the first charge is on the day the trial ends and, after that, every month or every year from that date. The price is the one for the period you chose and saw before paying; today, on the web, $14.99 USD a month or $99.99 USD a year, plus taxes if applicable.
• Cancel without paying anything. Cancel any time before the trial ends and you are charged nothing: online from your account, which opens Stripe's customer portal, or by writing to emilianodelpalac@gmail.com. If you cancel during the trial, you keep Premium until it ends. If you wrote to us to cancel before it ended and you were charged anyway, we refund that charge. • We confirm it in writing. When the trial starts we send you an email with these terms, the date of the first charge and how to cancel. • Refunds. The trial costs nothing. If you do not cancel in time and the first period is charged, that charge follows the rules for Premium and the refund policy: cancelling stops the next charges and the current period is not partially refunded. • Changes to the offer. We may change the length of the trial or stop offering it at any time, only for future purchases: a trial already started lasts what you agreed to and its first charge is the one you agreed to.
• Abuse. We may refuse the trial to anyone who tries to get more than one, for example with different emails for the same person.
• On the iPhone. If you subscribe inside the ORIGEN iPhone app, any free trial or introductory offer is decided and managed by Apple, with its own eligibility rules, and is cancelled in Settings → your name → Subscriptions. See Premium.

Failed payments and disputes

• If a charge fails, Stripe retries it for a few days. That window's box does not ship until the charge succeeds. If the retries run out, the Protocol is cancelled and nothing else is charged. [REVISIÓN LEGAL: retry schedule and customer notice]
• If you open a dispute or chargeback, we pause the pending charges and shipments of that purchase while it is resolved. Before disputing, write to us: it is almost always faster.

Refunds and shipping

• Refunds and returns: refund and return policy.
• Shipping: only to the 48 contiguous states and Washington, D.C. See the shipping policy.

Health and safety

• Always read the label and its warnings before taking a product.
• Talk to your doctor before starting, especially if you take medication, are pregnant or breastfeeding, or have a medical condition.
• If you notice an adverse reaction, stop taking it and see a health professional. Tell us: how to report an adverse event.

Your account and purchase records

• If you delete your account with an active Protocol or Premium (including during a free trial), before deleting it we cancel all your ORIGEN subscriptions in Stripe, at that moment, so there are no more charges. • Each purchase's records — amounts, dates, shipping address and your acceptance of the charges — are kept for the period the law requires, even if you delete your account. [REVISIÓN LEGAL: tax and consent retention periods]
• How we handle your data: privacy.

Liability, governing law and disputes

• Not medical advice. Nothing you see in ORIGEN — the analysis, the plan, the texts — is medical advice, diagnosis or treatment, nor a substitute for your doctor. See the full disclaimer.
• Limitation of liability. To the maximum extent the law allows, our total liability to you for a purchase does not exceed what you paid for that purchase, and we are not liable for indirect or consequential damages.
